MNG Terms and Conditions
Use of Service
MNG is a networking group for the purpose of fostering professional contacts. It is expected of the members to attend the meetings to maximize networking opportunities. MNG will provide a proper environment in which to conduct these meetings. The frequency and location is subject to change but always at a minimum of two meetings a month.
Member Commitment Pledge
As a member a MNG, we are all committed to the success of our own businesses and those of our fellow members. As in any endeavor in life, success brings with it responsibilities. These responsibilities are vital to a successful membership in order for you to get the most out of your time networking. As a member you are committed to adhere to these responsibilities, failure will lead to one’s loss of the right of first refusal and exclusivity of their position.
Therefore, I pledge to:
- Miss no more than 1 meeting per quarter, special exceptions are at the discretion of group leadership along with the consultation of the executive committee.
- Participate in 2 one on ones per month
- Provide 5 quality leads, referrals, or introductions per quarter
- Bring 2 visitors per quarter
- Participate in 1 committee for two quarters per year
Term
Should member decide to leave MNG before the year end, the member forfeits any refund of membership fee. MNG agrees that should member be asked to leave by the Membership Committee for any reason, MNG will refund a prorated amount of the membership fee. This contract automatically renews unless MNG or member cancels the membership. Notice will be given of contract renewal 30 days prior to anniversary; MNG reserves the right not to renew the membership contract for any reason.
Indemnification
By accepting Membership in MNG, you agree to indemnify and otherwise hold harmless MNG Corporation, itsofficers, employees, agents, subsidiaries, affiliates and other partners from any direct, indirect, incidental, special,consequential or exemplary damages resulting from your membership with MNG. Any business transactions whichmay arise between members from their use of MNG are the sole responsibility of the members involved. You understand and agree that MNG may disclose personally identifiable information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to comply with legal process, enforce thisMembership Contract, or protect the rights, property, or safety of MNG, its members, and the public.
Disclaimer of Warranties
YOU UNDERSTAND AND AGREE THAT MNG IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND THATMNG DOES NOT ASSUME ANY RESPONSIBILITY FOR ANY MEMBER INFORMATION OR COMMUNICATIONS BETWEENMEMBERS. MNG ASSUMES NO RESPONSIBILITY FOR THE ACCURACY OR EXISTENCE OF ANY COMMUNICATIONSBETWEEN MEMBERS. MNG MAKES NO GUARANTEE OF MONETARY GAINS ASSOCIATED WITH THIS MEMBERSHIP. MNG EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUTNOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE ANDNON-INFRINGEMENT.
MNG MAKES NO WARRANTY THAT (i) MNG WILL MEET YOUR BUSINESS GOALS, (ii) THE RESULTS THAT MAY BEOBTAINED FROM USE OF MNG WILL BE ACCURATE OR RELIABLE, AND (iii) THE QUALITY OF ANY PRODUCTS,SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH MNG WILL MEETYOUR EXPECTATIONS.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM MNG OR THROUGH OR FROM MNG SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS MEMBERSHIP.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OREXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Photograph Usage Disclaimer
Please note that photographs and footage will be taken throughout various MNG events and meetings. These may be used by MNG for marketing and publicity in our publications, on our website and in social media or in any third party publication. If you wish to be exempted from this clause please contact info@netwokmng.com using the subject “Opt-Out Photographic Usage”, and stating your preferences in the body of the communication.
Entire Agreement
The Membership Application and Rules and Regulations constitute the entire agreement between you and MNG and govern your use of MNG, superseding any prior agreements between you and MNG.
Severability
Invalidity or unenforceability of one or more provisions of this Agreement or the above shall not affect any other provision of this Agreement.
Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT MNG SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF MNG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT WILL MNG’S TOTAL CUMULATIVE DAMAGES EXCEED US $100.
Governing Law
The Membership Contract between you and MNG will be governed by and construed in accordance with the laws of the State of New York without regard to conflict of laws principles.
General Information
MNG, MNG logo, and other MNG logos and names are trademarks of MNG Corporation. You agree not to display or use these trademarks in any manner without MNG’s prior, written permission. The section titles of this Membership Application are displayed for convenience only and have no legal effect.
